A special meeting of the Philip City Council was held on May 11, 2009, at 5:30 p.m. in the Community Room of the Haakon Co. Courthouse.
Present were Mayor John F. Hart, Finance Officer Monna Van Lint, Council Members Shirley Chin, Monte Palecek, Tom Struble, John Kangas, Greg Arthur and Michael Vetter. Also present were Deputy Finance Officer Brittany Smith, Seth Hyberger with the Central SD Enhancement District; and later, Del Bartels of the Pioneer Review.

Mayor Hart called the meeting to order stating that the Council will be reviewing the Comprehensive Plan (CP) with Seth Hyberger with the Central SD Enhancement District (CSDED). He stressed that this is the time for the Council to ask questions and give input to Mr. Hyberger as he turned the meeting over to him.
Mr. Hyberger addressed the Council noting that the CP is a useful and essential planning tool that addresses the future goals of the community in accordance with SDCL 11-4-3.
He apologized for his previous meeting with the Council as he was not clear about the CP and the information he needed from the Council to finalize the plan. He has incorporated the community's 2004 Community Assessment and Horizon's Study Circle goals into the plan to address future economic development goals, parks and recreational goals, etc. He stressed that the information that has not been addressed and will be today is the Council's ideas for future land use of the City and community. For instance, where would the City like to grow and how would the City serve these areas.
He reviewed maps with the Council to identify areas for future and potential growth for residential, commercial and industrial zoning districts as well as the sewer lagoons and rubble site.
Council advised Mr. Hyberger of various areas where the City could potentially grow for residential districts and commercial and industrial businesses.
Council then went on to review the concerns with the Rubble Site as the current site is at capacity. The site has been utilized to its maximum for rubble site pits that are filled with items that can not be recycled or burned in accordance with the City's operating permit.
Mayor Hart stressed that if the City were to move the site; the City would be under more regulations from the SD Dept. of Environment and Natural Resources (DENR). It would require a new operating permit and be very costly to establish. With expansion of the current site, it would be grandfathered in with our current regulations.
Various areas were discussed and it was noted that the Council would prefer expanding the current site. If that is not an option, the possibility of purchasing additional land in close proximity of the current site may be pursued. Furthermore, if an additional site be the only option, it could be utilized for the pits and maintain the current site to collect the recyclables.
FO Van Lint went on to state that future expansion of the sewer lagoons was previously reviewed by Street/Sewer Supt. Rick Coyle and City Engineer Harlan Quenzer. This was done when Philip Livestock Auction was considering connecting into our sewer system to comply with SD DENR regulations. If this would have occurred, expansion of the lagoons would have been pursued at that time as they would have been over capacity.
Mr. Hyberger went on to discuss the City's option to request cooperation with the County to establish extraterritorial jurisdiction in accordance with SDCL 11-6-12.1. This would allow the City to implement zoning up to a maximum of six miles out of the City limits. In order to implement this, the City and County would have to establish a joint powers agreement with the exact distance that the City's zoning regulations would apply.
It was noted that the main reason for establishing the extraterritorial jurisdiction is to protect the community. For instance, if a hog confinement operation was going to build within two miles of the City, they would have to receive permission from the City.
Furthermore, it was stressed that the County does not have any zoning regulations to regulate such businesses none the less any building out in the County.
Council Member Arthur questioned if this would require all persons living in the extraterritorial jurisdiction to receive permission from the City to build, i.e. grain bins, barns, homes, etc.? Mr. Hyberger confirmed that the City would have to approve of any building in this area.
Mayor Hart recommended the Council visit with the County Commissioner's and Rita Merrill, County Director of Equalization, to obtain their input on the extra territorial jurisdiction.
Mr. Hyberger thanked the Council for their input and will be compiling the information for their review in the CP.
With nothing further, the Council adjourned at 6:16 p.m.
